The NAACP, Earthjustice, and the Southern Environmental Law Centre have filed a federal lawsuit against Elon Musk's xAI over its Memphis data center. The suit alleges the company installed and operated 27 gas turbines without the permits required under the Clean Air Act. Earthjustice estimates the turbines could release more than 1,700 tons of smog-forming nitrogen oxides each year, along with fine particulate matter, carbon monoxide, and formaldehyde. The NAACP argues the pollution disproportionately affects predominantly Black neighborhoods already dealing with high rates of respiratory illness. xAI has asked the court to dismiss the case, arguing the turbines are essential to running its Colossus supercomputer and Grok chatbot. The company says shutting the turbines down would force operations to stop abruptly. The Trump administration's Justice Department has also asked the court to dismiss the lawsuit, citing national security and economic interests tied to advanced AI infrastructure. The case highlights a growing tension between rapid AI infrastructure buildout and environmental regulation. As data center electricity demand surges, companies are turning to on-site gas generation when grid capacity falls short. This lawsuit tests whether federal clean air rules apply to that strategy, especially when facilities are located near vulnerable communities.
