Kenya's Court of Appeal has ordered a fresh review of a KenGen tender for Certified Emission Reductions (carbon credits) after Sintmond Group challenged the evaluation process. The court ruled that procurement entities cannot introduce new evaluation criteria during due diligence after bids have been submitted. The case, Tender No. KGN-SALE-005-2025, will now be heard by a new panel of the Public Procurement Administrative Review Board. The ruling reinforces that due diligence must stick to verifying what bidders already submitted, not adding fresh requirements. This matters for carbon credit sales and other climate finance deals where procurement rules intersect with environmental asset markets. The decision sets a precedent for how Kenyan public entities handle carbon credit tenders going forward.
