IRS 45Z guidance now covers manure biogas: what it means for RNG projects and farm emissions

The new guidance sets carbon intensity rates for manure-derived gas and other non-fossil fuels, ending years of uncertainty for biogas developers. Farms already use anaerobic digesters to break down manure and capture methane that would otherwise escape into the atmosphere, and the credit is expected to speed up projects that were waiting on clearer rules. But the credit is not a simple win. The payment is calculated against how a farm handled manure before, with liquid manure storage treated as the high-emitting baseline. That means operations with the dirtiest past practices get the biggest reward. Critics argue this effectively subsidizes the largest concentrated animal feeding operations and may encourage adding more animals, which can erase part of the methane gains. The USDA also still has a moratorium on loan guarantees for digesters through 2026, so financing remains a mixed picture even with the tax credit in place.
