EU Publishes ETS2 Compensation Rules for Fuel Consumers: Double Counting and Inadvertent Coverage
fasi.euThe European Union has published the implementing regulation for financial compensation to final fuel consumers under ETS2, the carbon trading system for buildings and road transport. The rules, which enter into force on November 26, 2026, address cases where fuel suppliers surrender allowances for end-uses outside the scheme's scope, including double counting with ETS1 and inadvertent coverage of non-covered activities. Member States can reimburse entities that paid carbon costs in error, using a calculation method based on reliable CO2 emission estimates and the average ETS2 allowance auction price during an eligible period. The regulation also sets reporting obligations for Member States, requiring annual submissions by June 30 on compensation granted, and establishes a mechanism to adjust the overall quantity of allowances in circulation starting in 2029. For Member States without unilateral ETS2 extensions, the adjustment equals the difference between verified emissions and CO2 from covered activities in national inventories. Missing or incomplete reports will lead the Commission to determine adjustments based on its own guidelines, ensuring the market reflects actual covered emissions.
