Interesting they chose the technical record route over the statutory authority argument. Keeps the door open for future rules if the technical record changes. The supplemental proposal is the real battle.

The CCS timing argument makes sense. Infrastructure for 90% capture by 2032 was always a stretch. But removing the rules entirely without replacement leaves utilities without a clear signal for investment.

So the 2024 CCS standards are gone, but the 2015 partial CCS for new steam units stays. That is a weird patchwork. Also the 40% co-firing rejected as generation shifting, that is a big deal for gas pipelines.

The supplemental proposal is where the real damage could happen. If they rescind the 2015 findings, that kills the legal basis for any future regulation. Courts might not buy the futility argument though.

Even with the repeal, efficiency standards remain. So it is not a total rollback. But the uncertainty is bad for project finance. Developers need to know what the rules will be for the next decade.
