EPA further delays 2025 GHGRP reporting deadline as 45Q carbon sequestration verification hangs in balance
ethanolproducer.comThe EPA has pushed back the 2025 reporting deadline for the Greenhouse Gas Reporting Program again. The agency is also moving to end the program entirely, arguing that Clean Air Act section 114(a) does not require collecting GHG data from businesses. That creates a problem for companies using Subpart RR to verify carbon sequestration volumes for the 45Q tax credit. Nebraska and Iowa attorneys general want the EPA to keep Subpart RR as an opt-in reporting program so ethanol producers can still use 45Q and 45Z. Treasury and the IRS have already issued interim guidance and modified the 45Q safe harbor to help taxpayers if the EPA repeals the reporting program. The open question is how companies will prove sequestration volumes without the EPA reporting structure in place.
