EKI Energy Services Fined Rs 88 Lakh by SEBI for Premature Revenue Recognition and Unsupported Expenses
moneylife.inIndia's market regulator SEBI has fined EKI Energy Services and seven of its directors and officials a total of Rs 88 lakh for financial misrepresentation. The company, which trades carbon credits and manages carbon offset projects, was found to have booked Rs 197.04 crore in revenue prematurely during the first three quarters of FY22-23. It also recorded Rs 26.34 crore in unsupported commission, consultancy, and professional expenses. SEBI has barred the company from the securities market for two months, and four individuals, including the managing director, for periods ranging from one to twelve months. The case centers on EKI's improved cookstove projects. The company recognized revenue when cookstoves were deployed, but its contracts required the delivery of verified carbon units to buyers. SEBI ruled that deployment alone did not complete the contractual obligations. The regulator also found that the company continued to report overstated figures even after its auditor raised concerns, and that payments and adjustments were linked to the actual generation and delivery of carbon credits. For investors and companies in the carbon credit space, this order is a reminder that revenue recognition rules apply strictly to carbon offset projects. Carbon credits are not revenue until they are verified and delivered. The penalty also highlights the need for proper documentation of service expenses, especially in a sector where many transactions involve cross-border partners and complex project structures.
