Colorado wins EPA approval to regulate underground carbon storage wells
kiowacountypress.netColorado will take over permitting and enforcement for underground carbon storage wells after EPA approved the state's request for Class VI primacy. Starting November 12, 2026, the Colorado Energy and Carbon Management Commission will handle permits, monitoring, and site closure for wells that inject carbon dioxide into deep rock formations. EPA will keep federal oversight and retain authority for projects on Tribal lands. The state has been preparing for this role since 2023, when the legislature authorized ECMC to pursue primacy. Colorado submitted its application in October 2025, EPA proposed approval in March 2026, and the final rule was issued October 13, 2026. Operators will still need to meet federal drinking water protections, show financial assurance, and fund long-term site care through the Geologic Storage Stewardship Enterprise.
